IJudge Opinions, Inc. ("IJudge", "us" or "we") respects the privacy of the visitors to its mobile applications ("IJudge - The Opinion App", "app", "apps"), to its website ( http://www.ijudge.info, "Site"), and of anyone using our consumer, publisher, agency, advertiser, or other services ("Services"), which include our Site, APIs, mobile applications, surveys, dashboards, scripts, links, buttons, browser add-ons, plug-ins, widgets, and/or other hardware or software technology.
Information Collected by IJudge
We collect each Member's email address, username (“Judgename”, "Judge name", "User ID"), and password upon signup for consumer membership. Account passwords are created via cryptographic hash function and can be reset, but not recovered or known by us. Any other personal information gathered by us is done so via voluntary entry of said information as profile data by Members, or via dropdown selectors capturing generic demographic information. We may require that agency and other commerical accounts provide additional information to us to obtain membership and access our Services.
Some of our Services may be used anonymously and require no signup or login. Anonymous users and Visitors may not create accounts or receive other benefits available to Members.
Members may upload and share items to Opinion Court, which links their username to said items. Court visitors may complete IJudge Case Surveys about any Court item. All results of said Surveys are public, unless options for private viewing are offered by us and selected by the respective Member. We receive and store any information, including opinion scores and comments about content, Members and visitors enter using our Services.
Non-identifiable use of user data
We may use data from users who access our services through Court, publisher, agency or other third party channels in a non-identifiable manner to associate specific opinions, opinion scores, comments, URLs and content with IP information, behavioral, demographic, geographic, calendar, and time parameters. By so doing, we can attempt to achieve a mission goal of accurately measuring audience, user and consumer opinion.
Event information and data integrity
We receive and store certain types of event information whenever you interact with us anonymously as a Visitor or as a Member. IJudge and its authorized agents automatically receive and record certain analytical data, markup language and source data on their server logs from your browser including your IP address, device ID, geographical information, IJudge data stored on your device (cookie information), and the page you requested. IJudge uses this event data to help categorize selected links and URLs, assign database information about pages, quantify public opinion, diagnose problems with its servers, analyze trends and administer the website.
An IP Address is a number that is automatically assigned to your computer when you use the Internet. In some cases your IP Address stays the same from browser session to browser session and in other cases it may vary. We track IP Addresses and device IDs and utilize other relational database technology to help achieve a primary mission of gathering reliable public opinion information. On this basis, the Site attempts to prevent self-promotion, fraud, SEO and SEM use, manipulation of Case Survey results, and other abuse by limiting each person to one Membership and by limiting each person to one (1) total Judgments regarding any specific Case, URL or Court item. Please read our Terms of Service for more information of unauthorized Site usage.
When you score opinions about content using the IJudge Opinion Slider, either directly from our site or app, or by other means made available now or in the future by us, you are explicitly and publicly expressing your opinions regarding said content. Any said scored opinion made by a Member may be edited or deleted by that Member at any time. IJudge uses scoring and event information to gather and measure audience and public opinion, provide data to Member dashboards and Chambers, develop algorithmic Congruence scores, faciliate Member and content discovery and connection, and to enable potential business opportunities for Members and others.
Disclosure of Personal Information
Any information contained on publicly available portions of the Site and not password protected may be accessed by third party search engines or other programmed means and we cannot control ensuing dissemination of said information. If our company or our assets are acquired by another company, that company will possess the personal and profile information collected by us and it will assume the rights and obligations regarding this information. You may change or delete any of the personal information in your Chambers, profile or Dashboard by editing it at your convenience.
Information about Children
We do not intentionally gather personal information about Site users who are under the age of 13. Members must be 13 years and older to use our Services. We recommend that minors between the ages of 13 and 18 ask and receive their parents' permission before using our Services or completing any profile information.

Safety of your personal information
We use reasonable measures to maintain the security of your profile and personal information. It is impossible to eliminate all security risks associated with the storage of digital information. Your IJudge account information is protected by a password for your privacy and security. Members should protect against unauthorized access to passwords and to your computing device by logging off once you have finished using any said device, especially if it may be a computing device shared by others.

Terms of Service
Acceptance of Terms and Use of our Services
IJudge Services (“Services”) include our APIs, Opinion Court, Court Surveys, mobile applications ("IJudge The Opinion App", “app” or “apps”), web pages (www.IJudge.info, “Site”), scripts, embeds, buttons, plug ins, widgets, website applications, browser extensions, and other products and services for consumers, companies, creators, influencers, brands, publishers, advertisers and agencies. Our Services are owned and operated by IJudge Opinions, Inc., a California corporation, and are accessed by you under the Terms of Service described herein (“Terms of Service”).
Please read these Terms of Service carefully before using IJudge or its Services. By accessing our Services, you ("user", "Member", "Judge", "Creator", "Publisher", "Agency", "Anonymous user", "Visitor", "client", "customer") agree to become bound by these terms and conditions. If you do not agree to all the terms and conditions, then you may not access our Services, or download our apps, scripts, links, or other products, or use the content of any Services offered. IJudge’s acceptance is expressly conditioned upon your assent to all these terms and conditions, to the exclusion of all other terms; if these terms and conditions are considered an offer by IJudge, acceptance is expressly limited to these terms.
Availability of our Services
Subject to full compliance with the Terms of Service, IJudge may offer to provide certain services and content, our Services. IJudge may change, suspend or discontinue our Services for any reason, at any time, including the availability of any feature or content. IJudge may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability.
Your Membership Obligations
Membership ("accounts") may be granted and revoked at our sole discretion to consumers, creators, influencers, publishers, agencies and other organizations, companies and entities. Membership requires user entry of a valid email address, a User ID ("Judgename", "Username") and a password. Agency, corporate and other accounts may require that additional information be provided to begin and/or maintain Membership. Membership is limited to one Username per person or registered business.
You may not (i) select or use as a Username or Member ID a name of another person with the intent to impersonate that person; (ii) use a Username subject to any rights of a person other than you without appropriate authorization; or (iii) use a Username that is otherwise offensive, vulgar or obscene. We reserve the right to refuse registration of, or cancel a Username at our discretion; if you select a Username for your account we reserve the right to remove or reclaim it if we believe it infringes upon another’s rights or marks or attempts to impersonate administrator Judge names. You are responsible for maintaining the confidentiality of your IJudge password.
Members must conform to all instructions provided in regards to creating, editing, distributing and managing surveys, Cases and APIs. Accounts may be suspended or closed, with or without notice prior notice from us, for using our API, Cases, Court, Chambers, survey and dashboard services in any manner which may violate the terms herein or damage the intellectual property rights, goodwill, brand image, business pursuits, or reputation of IJudge or any other organization or person.
Users may access and use our Services without becoming Members on our site or app via Court surveys ("Anonymous users", "Visitors"). Anonymous users are bound to all Terms of Service described herein and as applicable. Anonymous uses are identified to us by device ID or IP address and may browse and utilize some of our Services but may not interact directly with Members other than by posting scores and comments on Cases and surveys made available to them.
Services are available only to individuals who are at least 13 years old, whether acting on their own behalf or as an authorized employee or representative of a corporation or other business entity. If you are under 13 years old, do not attempt to register or use the Services.
Your Conduct as a User or Member
As a condition of use, you agree and are hereby obligated not to use our Services for any purpose that is unlawful or prohibited by these Terms of Service, or any other purpose not reasonably intended by IJudge. We respect other people’s rights and we expect all users to do the same.
In no manner limiting and by way of example only, you agree not to use our Services:
to abuse, harass, threaten, impersonate or intimidate others;
to upload, share, link to, post or transmit any content that is infringing, libelous, defamatory, obscene, pornographic, abusive, offensive, profane, or otherwise violates any law or right of any third party, or content that contains threatening or hateful images or speech of any kind.;
for any illegal or unauthorized purpose. If you are an international user, you agree to comply with all local laws regarding online conduct and acceptable content;
to post or transmit any communication or solicitation designed or intended to obtain password, account, or private information from any IJudge user;
to create or submit unwanted email (“Spam”) to any other IJudge users or any URL;
to violate any laws in your jurisdiction (including but not limited to copyright laws);
to submit stories or comments linking to multi-level marketing schemes
you will not use any robot, spider, scraper or other automated means to access our Services for any purpose without our express written permission. Additionally, you agree that you will not: (i) take any action that imposes, or may impose in our sole discretion an unreasonable or disproportionately large load on our infrastructure; (ii) interfere or attempt to interfere with the proper delivery of our Services; or (iii) bypass any measures we may use to prevent or restrict access to our Services;
with the intention of artificially inflating or altering IJudge rankings, scores, comments, or any other IJudge product or service, including by way of creating separate user accounts for the purpose of artificially altering rankings and scores; giving or receiving money or other remuneration in exchange for Judgments, Verdicts, Ratings, or scores; or participating in any other organized effort that in any way artificially alters the database, results, scores, opinon measurement or other content, product or service of IJudge;
attempt to impersonate another user or person;
sell or otherwise transfer your Username. In addition, you agree that you will not use our Services on behalf of (or per the request or instruction of) any third party, or pay or otherwise attempt to influence any third party to manipulate or otherwise affect the site in any manner.
IJudge may remove any content and IJudge accounts at any time for any reason.
You are solely responsible for your interactions with other users of the Site. IJudge reserves the right, but has no obligation, to monitor disputes between you and other users.

Content submitted or made available for inclusion on our Services
By creating and posting content, which includes Court Cases and surveys, opinion scores, photos, links, comments, and other materials, to IJudge, you warrant that you own all rights to the content, agree that the content will be dedicated to the public domain under the Creative Commons Public Domain Dedication, available at http://creativecommons.org/publicdomain/zero/1.0/ and that you will not object to the use or distribution of the content by IJudge or IJudge users in any context for any time period, even if you subsequently delete or remove said content from appearing in subsequent versions of your Chambers, profile or other account storage or display area.
Copyright and Infringement Complaints
IJudge respects the intellectual property of others. It is IJudge’s policy to respond expeditiously to claims of copyright and other intellectual property infringement. We will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act (“DMCA”) and other applicable intellectual property laws. Upon receipt of notices complying or substantially complying with the DMCA, IJudge may act expeditiously to remove or disable access to any material claimed to be infringing or claimed to be the subject of infringing activity and may act expeditiously to remove or disable access to any reference or link to material or activity that is claimed to be infringing. IJudge will terminate access for subscribers and account holders who are repeat infringers.
Notifying IJudge of Copyright Infringement: To provide IJudge notice of an infringement, you must provide a written communication to the attention of “DMCA Infringement Notification Dept.” care of inquiry@IJudge.info that sets forth the information specified by the DMCA (http://www.copyright.gov/title17/92chap5.html#512). Please note that we may post your notification, with personally identifiable information redacted, to a clearinghouse such as chillingeffects.org. Please also note that you may be liable for damages (including costs and attorneys’ fees) if you materially misrepresent that an activity is infringing your copyright.
Providing IJudge with Counter-Notification: If you feel that your material does not constitute infringement, you may provide IJudge with a counter notification by written communication to the attention of “DMCA Counter Notification Dept.” at inquiry@IJudge.info that sets forth all of the necessary information required by the DMCA (http://www.copyright.gov/title17/92chap5.html#512). Please note that you may be liable for damages (including costs and attorneys’ fees) if you materially misrepresent that an activity is not infringing the copyrights of others. If you are uncertain whether an activity constitutes infringement, we recommended seeking advice of an attorney.
IJudge is the holder of United States patent numbers 8,738,623 and 9,396,271 (Global Reverse Lookup Public Opinion Directory) which protects the Opinion Slider system and method, comprising the presentation of fixed vocabulary words naming specific human values, beliefs, opinions, feelings, emotions, or judgments, grouped as scrollable antonym pairs displayed singularly with pair elements on opposing ends of a graphical slide track, and the generation, storage, forward and reverse lookup utilization of individual and cumulative scores created by graphical slider knob movement along said track. Unauthorized or unlicensed use of our intellectual property is prohibited. No user, Judge, Member, creator, visitor, publisher, agent, customer or other person, organization or entity may use, copy, transform or implement the Opinion Slider or any other IJudge system, method, or property protected under patent, trademark, copyright, or common law without the expressed written consent of IJudge. Links and Merchandise
The Services may provide, or third parties may provide, links to other World Wide Web sites or resources. Because IJudge has no control over such sites and resources, you acknowledge and agree that IJudge is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that IJudge shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.
Neither IJudge nor its third party service providers make any warranties with respect to any of the merchandise, products, and/or services featured, mentioned, or sold by others on or through the Site. Transactions for any such item shall be between the user and the third party seller, without any involvement of IJudge or its third party service providers. You agree that IJudge and its third party service providers are not responsible, and shall have no liability to you, with respect to merchandise, products, and/or services featured, mentioned, or sold by others on or through the Site, including illegal, offensive or illicit items, or items that violate this Agreement.
You will indemnify and hold harmless IJudge, its parents, subsidiaries, affiliates, customers, vendors, officers and employees from any liability, damage or cost (including reasonable attorneys. fees and cost) from (i) any claim or demand made by any third party due to or arising out of your access to the Site, use of the Services, violation of the Terms of Service by you, or the infringement by you, or any third party using your account or Judge User ID, of any intellectual property or other right of any person or entity.
You acknowledge that IJudge has no control over, and no duty to take any action regarding: which users gain access to or use our Services; what effects the content may have on you; how you may interpret or use the content; or what actions you may take as a result of having been exposed to the content. You release IJudge from all liability for you having acquired or not acquired content through our Services. Our Services may contain, or direct you to sites or content containing, information that some people may find offensive or inappropriate. IJudge makes no representations concerning any content contained in or accessed through our Services, and IJudge will not be responsible or liable for the accuracy, copyright compliance, legality or decency of material contained in or accessed through the Site or the Services. OUR SERVICES AND CONTENT ARE PROVIDED ON AN “AS IS” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
Limitation of Liability
In no event shall IJudge or its suppliers be liable under contract, tort or strict liability, negligence or other legal theory (i) with respect to the Site, the Service or any content for any lost profits or special, indirect, incidental, punitive or consequential damages of any kind whatsoever, substitute goods or services (however arising), or (ii) for any direct damages in excess of (in the aggregate) $100. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations and exclusions may not apply to you.
IJudge may terminate or suspend any and all Services and your IJudge account immediately, without prior notice or liability, if IJudge has a reasonable belief that you may have breached any of the terms or conditions of the Terms of Service. Upon termination of your account, your right to use the Services will immediately cease. If you wish to terminate your IJudge account, you may simply discontinue using the Services and remove any installed apps, scripts, or other software or hardware that may have been provided to you during your membership period. All provisions of the Terms of Service which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
No agency, partnership, joint venture, or employment is created as a result of the Terms of Service and you do not have any authority of any kind to bind IJudge in any respect whatsoever. The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder. IJudge shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond IJudge’s reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation (including “line-noise” interference). If any provision of the Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms of Service shall otherwise remain in full force and effect and enforceable. The Terms of Service is not assignable, transferable or sub-licensable by you except with IJudge’s prior written consent. IJudge may transfer, assign or delegate the Terms of Service and its rights and obligations without consent. The Terms of Service shall be governed by and construed in accordance with the laws of the state of California, as if made within California between two residents thereof, and the parties submit to the exclusive jurisdiction of the Superior Court of Ventura County and the United States District Court for the Southern District of California.
Modifications of the Terms of Service
We may revise these terms from time to time, and the most current version will be at http://www.ijudge.info/service-terms. If the revision, at our sole discretion, is considered a material change we will notify you by posting an announcement on the Site. You are responsible for reviewing and becoming familiar with any modifications. Use of the Services after such notification constitutes your acceptance of the terms and conditions of the Terms of Service as modified.
